§ 1. General provisions
1. These Regulations for the provision of services by electronic means define the scope and conditions for making and booking an appointment at NZOZ Dr. Frankel’s.
2. Definitions:
1. Price List – a price list of the Services, made available to the Patient on the Provider’s Website,
2. Patient – an individual who uses services provided electronically by the Service Provider,
3. Rules and Regulations – these rules and regulations for the provision of services by electronic means, made available free of charge on the website https://drfrankels.clinic in a form that allows its downloading, recording and printing, so as to allow free reading of the provisions of the Rules and Regulations before their acceptance,
4. website – the website of the Service Provider, used for making and booking appointments, available at http://drfrankels.medfile.pl
5. Service – a service provided by the Service Provider, which consists in providing the Patient with the possibility of making and booking an appointment.
6. Service Provider – Agnes Frankel conducting business under the name of Agnes Frankel, 58 Stara Droga Street, 43-190 Mikołów, NIP 6351808239, e-mail address for contact: recepcja@drfrankels.pl, phone: 789375101.
3. In order to use the Service, you must read the Terms and Conditions carefully and accept them. Failure to accept the terms of the Terms and Conditions prevents use of the Service.
4. other services, i.e. visit, are held in person at the office, at the time and place indicated when booking the appointment. The terms and conditions of other services are not covered by the Regulations.
§ 2. Use of services provided and fees
1. reservation of an appointment is made by phone at +48789375101.
2. A patient booking an appointment shall:
– provide the required data: name and phone number;
– pay an advance payment of PLN 200. If the visit is carried out as part of a previously purchased treatment package or voucher, no additional prepayment is required (then points 4-8 of this paragraph do not apply).
3. Provision of data by the Patient is tantamount to his/her declaration of truthfulness of all data provided to the Service Recipient and possession of full legal capacity, or in the case of its limitation possession of the necessary consent of the legal guardian.
4. Once the appointment is made, a link will be sent to the phone number provided by the patient, leading to a page for prepayment.
5. The condition for booking an appointment is payment of a prepayment in the form of an advance of PLN 200. Prepayment shall be considered made only after it is credited to the Service Provider’s bank account or payment intermediary service confirms the payment.
6. In case of non-payment of prepayment up to 48 h after the establishment of the reservation or immediately in case of booking an appointment less than 48 h before the selected appointment, the appointment is considered unreserved and available for other potential patients.
7. Prepayment can be made as follows:
1. via payment channels available on the Service Provider’s Website 2. by bank transfer to the Service Provider’s bank account.
8. The Patient will receive information about the booking of the prepayment and confirmation of the appointment or its cancellation due to non-payment of the prepayment on the phone number provided when making the appointment.
§ 3. Complaints
1. The Patient has the right to report complaints related to the Service via e-mail to the Provider’s e-mail address indicated in these Regulations.
2. The time limit for processing complaints is a maximum of 14 working days from the date of receipt of the complaint.
§ 4. Cancellation or rescheduling of an appointment
1. cancellation of the appointment on the booked date is possible at the latest 48 h before the date. In case of no-show at the scheduled appointment and no cancellation at the indicated time, the prepayment made (including the value of the treatment package or voucher to be used as part of the scheduled visit) is non-refundable.
2. Cancellation of a booked appointment is possible by calling +48 789375101 or sending an e-mail to the Service Provider’s e-mail address provided in the Terms and Conditions. The service provider does not provide any other possibility of cancellation.
3. Failure to appear at the scheduled appointment or failure to cancel within the indicated period will result in forfeiture of the prepayment. Prepayment is non-refundable regardless of the reason.
4. If the Patient is late for a booked appointment, the appointment will be shortened by the time of lateness, while the fee remains unchanged. In case of lateness exceeding half of the scheduled appointment time, the Service Provider is entitled to cancel the appointment booking, resulting in forfeiture of the prepayment (including the value of the treatment package or voucher to be used as part of the scheduled visit). Prepayment is non-refundable regardless of the reason for lateness.
5. The service provider reserves the right to cancel a booked appointment no later than one hour before the appointment. In case of cancellation, the Service Provider will offer the Patient a new appointment. If the new appointment is not accepted or not offered, the Service Provider will refund to the Patient the entire prepayment.
6. The Service Provider shall refund the prepayment within 7 days from the date of cancellation of the booked appointment in accordance with the Regulations.
§ 5. Technical requirements
1. The Payment Website can be accessed on a computer or mobile device under the following conditions:
1. use one of the following browsers: Internet Explorer, Microsoft Edge, Chrome, Mozilla Firefox, Opera or Safari,
2. use of one of the operating systems: Windows, macOS, Linux/Ubuntu, 3. minimum hardware requirements:
1. Pentium 4 or later processor supporting SSE2 (all modern processors),
2. 512MB of RAM for 32-bit systems and 2GB of RAM for 64-bit systems,
3. a minimum of 200 MB of free disk space to store temporary data and cookies,
4. permanent connection to the Internet.
§ 6. Final provisions
1. The Service Provider reserves the right to make changes to the Terms and Conditions.
2. Any disputes between the Service Provider and the Patient shall be resolved amicably.
3. In case of failure to resolve disputes amicably, between the Service Provider and the Patient, the competent court shall be the Court of local and material jurisdiction for the place of the Service Provider’s headquarters.
4. In matters not covered by these Regulations, the provisions of generally applicable Polish law shall apply.
5. these Regulations are effective as of 01.05.2024.
